การจับ

     ในการรวบรวมพยานหลักฐาน เจ้าพนักงานตำรวจอาจจำเป็นต้องค้นหา สิ่งของหรือบุคคล เมื่อเจ้าพนักงานตำรวจขอเข้าตรวจค้น จะต้องแสดงความบริสุทธิ์ต่อผู้ครอบครองสถานที่หรือบุคคลในครอบครัวและแสดงหมายค้น

ผู้ได้รับหมายค้นควรตรวจสอบดังนี้

๑. สถานที่ออกหมาย ต้องออกโดยศาล

๒. วันเดือนปีที่ออกหมาย

๓. เหตุที่ออกหมายค้น ได้แก่

- เพื่อพบและยึดสิ่งของซึ่งจะเป็นพยานหลักฐาน

- เพื่อพบและยึดสิ่งของซึ่งมีไว้เป็นความผิด หรือได้มาโดยผิดกฎหมาย หรือมีเหตุอันสมควรสงสัยว่าได้ใช้ หรือตั้งใจจะใช้ในการกระทำความผิด

- เพื่อพบและช่วยบุคคลซึ่งถูกหน่วงเหนี่ยวกักขัง

- เพื่อพบบุคคลซึ่งมีหมายให้จับ

- เพื่อพบและยึดสิ่งของตามคำพิพากษาหรือตามคำสั่งศาลซึ่งจะพบหรือยึดโดยวิธีอื่นไม่ได้แล้ว

๔. สถานที่ที่จะค้น และชื่อหรือรูปพรรณบุคคล หรือลักษณะสิ่งของที่ต้องการค้น กำหนดวันเวลาที่จะค้น ชื่อและตำแหน่งของเจ้าหน้าที่ที่จะค้น

๕.ความผิดที่ระบุในหมายค้น

๖.ลายมือชื่อผู้พิพากษาและตราประทับของศาล

เมื่อตรวจสอบเห็นว่าถูกต้อง ก็ให้ความร่วมมือเจ้าพนักงานตำรวจโดยพาไปค้น สิ่งที่ควรทราบคือ การค้นในที่รโหฐาน (ที่ส่วนตัว) ต้องทำระหว่างพระอาทิตย์ขึ้นและตก (เวลากลางวัน) เว้นแต่ลงมือค้นในเวลากลางวันแต่ยังไม่เสร็จ ต้องค้นต่อในเวลากลางคืน หรือกรณีฉุกเฉินอย่างยิ่ง และการค้นเพื่อจับผู้ดุร้ายหรือผู้ร้ายสำคัญจะทำในเวลากลางคืนก็ได้ โดยต้องได้รับอนุญาตพิเศษจากศาล

เมื่อตรวจค้นเสร็จ เจ้าพนักงานตำรวจจะบันทึกรายละเอียดการค้นและบัญชีสิ่งของที่ค้นได้ แล้วอ่านให้ผู้ครอบครองสถานที่หรือบุคคลในครอบครัวฟังแล้วให้ผู้นั้นลงลายมือชื่อรับรองไว้

Search

In collecting evidence, police officers may need to search for things or persons. Before commencing a search, the police officer shall present the warrant and make himself manifest to the occupant of the premises or his family member that the search will be conducted with equity and fairness. On the other hand, any person in the place to be searched should inspect the warrant relating to the following

1. The place of issue (the court only);

2. The date of issue;

3. The cause for which such place is required to be searched:

- To discover and seize any item which may be used as evidence;

- To discover and seize any item the possession of which is an offence, or which has been unlawfully obtained or which is reasonably suspected to have been used or intended to be used for committing an offence;

- To discover and rescue any person who is wrongfully restrained or confined;

- To discover any person against whom a warrant of arrest has been issued; or

- To discover and seize any item according to the judgment or order of a court, in case where such discovery or seizure cannot be otherwise affected;

4. The place to be searched and the name or description of the person or property to be searched, date and time when the search is to be conducted, name and position of the officer who will conductthe search;

5. The offence;

6. The signature of a judge and seal of the court.

When the warrant is found to be duly issued, the cooperation with the police officer to search should be provided. It should be noted that a search in a private place shall be conducted between sunrise and sunset (Daytime). However, the search may be conducted. at nighttime, if specially authorized by the court together with one of the following exceptions: (1) when a search has begun during daytime, if unfinished, it may be continued into the night; (2) in case of extreme exigency; (3) a search for the arrest of a person who is known as dangerous or notorious outlaw.

When the search is duly completed, the officer shall record the details of the search and list of items found in the search. The aforesaid record shall be read to the occupant of the premises or his family members and signed by those persons in acknowledgement thereof.
